Terms and conditions of sale

Translation provided for information only. In the event of any discrepancy, the French version prevails: read the French version.

The French version of this document is the authoritative one; French is the language of the contract.

Parties

These terms govern the sale of refurbished devices on therefurbisher.com by GLASSY TECH, a SARL with share capital of 12 000 €, whose registered office is at 971 avenue de Toulouse, 31810 Vernet, registered with the Toulouse Trade and Companies Register (RCS) under number 889 820 809, SIRET 889 820 809 00016, intra-Community VAT number FR32889820809 (hereinafter “we”).

They apply to any natural person of full age acting for non-professional purposes (hereinafter “you”).

Contact (orders and after-sales service): [email protected].

Countries served

We deliver to metropolitan France, including Corsica, and to the following countries of the European Union: Germany, Austria, Belgium, Bulgaria, Croatia, Denmark, Spain, Estonia, Finland, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Sweden and Czechia.

For the time being, we do not deliver to Cyprus or Malta. Nor do we deliver to the French overseas departments and territories, Monaco, Switzerland, the United Kingdom or any other country outside the European Union. An order to any other destination is refused before payment.

Products

We sell second-hand devices that are refurbished within the meaning of Article L. 122-21-1 of the French Consumer Code: each one is tested on all its functions in our workshop in Toulouse, on a diagnostic station, after which its data is erased and it is reset.

The photo is that of the model; the exact colour is the one stated on the product page.

Accessories: a compatible charging cable is supplied. The device is delivered without a mains charger, without its original box and without earphones. It is unlocked for all networks and is not linked to any account (iCloud, Google).

The condition grades of our devices

All our devices work perfectly: they are checked on a diagnostic station and their data is erased. The condition grade describes only their appearance. We sell only three condition grades, stated on each product page:

Battery: on receipt, its capacity is guaranteed to be at least 85% of the original capacity for smartphones and tablets, and at least 80% for computers. Where the product page states “Replaced battery”, the battery has been replaced with a battery whose maximum capacity is 100%.

Prices

Prices are stated in euros, inclusive of all taxes. Second-hand devices fall under the VAT margin scheme (Article 297 A of the French General Tax Code): VAT is not shown separately on the invoice, which bears the statement “Régime particulier - Biens d'occasion” (margin scheme - second-hand goods).

Delivery is free: the price displayed is the price paid. The total price is displayed before payment.

Order and payment

The order becomes binding upon payment on the secure page of our service provider Stripe (bank card). We neither see nor store your card details.

No device is reserved before payment. The availability of each device is checked again just before payment: if it is no longer available, you are notified, it is removed from your basket and nothing is charged.

If, despite this check, a device turns out to have been sold in the meantime, the order is cancelled, you are informed by e-mail and you are refunded in full to the payment method used, within 7 days.

A confirmation e-mail summarises your order; the invoice is sent to you by e-mail upon dispatch. We may also cancel and fully refund an order if, during the final check before dispatch, the device turns out not to conform to its product page.

Delivery

The device is shipped from our workshop in Toulouse by DHL, with tracking, and handed over against signature: DHL Express in France, DHL Economy Select in the other countries of the European Union.

Dispatch: an order paid for before 12:00 (Paris time) on a working day is dispatched the same day; if paid for after 12:00, or on a Saturday, a Sunday or a public holiday, it is dispatched on the next working day. Working days are Monday to Friday, excluding public holidays in France.

Delivery: as an indication, in France, on the working day following dispatch; in the other countries of the European Union, 2 to 5 working days after dispatch depending on the country. The expected dispatch and delivery dates are displayed before payment.

Unless a date has been announced, the device is delivered to you no later than 30 days after the order (Article L. 216-1 of the French Consumer Code). Failing this, you may give us formal notice to deliver within a reasonable additional period, and then terminate the contract if delivery does not take place (Article L. 216-6); you are then refunded within 14 days.

The risk of loss of or damage to the device passes to you when you take physical possession of it (Article L. 216-4).

If the parcel is damaged, we invite you to record reservations with the carrier and to notify us within 3 days: this report makes it easier to process your case, but does not deprive you of any right.

Right of withdrawal

In accordance with Articles L. 221-18 et seq. of the French Consumer Code, you have 14 days from receipt of the device to withdraw, without giving any reason. If an order comprises several devices delivered separately, this period runs from receipt of the last one.

To exercise it, inform us of your decision by an unequivocal statement, for example by e-mail to [email protected] or by using the model form set out in the annex.

The device must be sent back to us, complete, within 14 days of the day on which you communicate your decision. The return is free of charge: we provide you with a prepaid return label.

We will reimburse all payments received from you no later than 14 days after being informed of your withdrawal, using the same means of payment as you used for the order. This reimbursement may be deferred until we have received the device back or until you have supplied evidence of having sent it (Article L. 221-24).

You may be held liable for any diminished value of the device resulting from handling other than what is necessary to establish its nature, characteristics and proper functioning (Article L. 221-23).

Before returning it, back up your data and remove your account (iCloud, Google). If the device reaches us still linked to your account, we will ask you to remove it remotely. Failing this, we may deduct from the reimbursement an amount equal to the resulting loss in value, as established and substantiated (Article L. 221-23). The reimbursement is never refused on this ground.

Legal guarantees

All our devices benefit by operation of law, and at no extra cost, from the legal guarantee of conformity (Articles L. 217-1 to L. 217-32 of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code), under the conditions set out in the box below.

To invoke them, write to us at [email protected] with your order number: we will provide you with a prepaid return label.

Legal guarantee of conformity and guarantee against hidden defects: regulatory information box (annex to Article D. 211-2 of the French Consumer Code)

The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity appearing. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

Where the contract for the sale of the goods provides for the supply of digital content or a digital service on a continuous basis for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the intended period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.

The legal guarantee of conformity entails an obligation for the trader, where applicable, to provide all updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity entitles the consumer to the repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience to the consumer.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests the repair of the goods but the seller imposes their replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund in return for the goods, if:

  1. 1° The trader refuses to repair or replace the goods;
  2. 2° The repair or replacement of the goods takes place after a period of thirty days;
  3. 3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
  4. 4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. In that case, the consumer is not required to request the repair or replacement of the goods first.

The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are out of use for the purpose of their repair or replacement suspends the remaining guarantee period until the delivery of the goods restored to working order.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to up to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in return for the goods.

For second-hand goods, including refurbished products, this presumption period is twelve months (Article L. 217-7 of the French Consumer Code).
